Terms & Conditions

Welcome to the website of Backflow Testers of Florida. By accessing our website, requesting a quote, or scheduling our services, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. Services Provided

Backflow Testers of Florida provides certified backflow prevention assembly testing, reporting, repair, and installation services.

  • Compliance Reporting: As part of our standard testing service, we will submit the required compliance reports to your local water authority or municipal purveyor on your behalf.

  • Service Adjustments: We reserve the right to refuse service or adjust quotes if the actual field conditions differ significantly from the information provided at the time of scheduling.

2. Access to Property and Assemblies

To perform our services safely and efficiently, the customer agrees to provide:

  • Clear Access: Unobstructed access to the backflow prevention assembly. This includes ensuring gates are unlocked, pets are secured indoors, and landscaping or debris does not block the unit.

  • Water Shut-off Consent: Acknowledgment that testing requires temporarily shutting off the water supply to the property. Backflow Testers of Florida is not liable for any temporary business interruptions or residential inconveniences caused by standard testing procedures.

  • Trip Fees: If our technician arrives and cannot access the assembly due to locked gates, loose animals, or severe obstructions, a standard trip charge may be assessed to reschedule.

3. Limitation of Liability & Pre-Existing Conditions

Backflow testing requires putting the assembly and surrounding valves under pressure and turning shut-off valves that may not have been operated for a year or more.

  • Pre-existing Degradation: We are not liable for the failure of pre-existing, aged, rusted, or degraded plumbing components, including older shut-off valves that may leak or break during standard, industry-compliant testing procedures.

  • Consequential Damages: To the maximum extent permitted by law, Backflow Testers of Florida shall not be liable for any indirect, incidental, or consequential damages (including water damage from pre-existing faulty plumbing) resulting from the performance of our standard testing.

4. Payment Terms

  • Due Date: Payment for testing services is due upon completion of the test unless prior net-billing terms have been established for commercial accounts.

  • Reporting Delays: Compliance reports will generally not be submitted to the local water purveyor until payment has been cleared or terms have been mutually agreed upon.

  • Late Fees: Past-due balances may be subject to a late fee or interest charges as permitted by Florida state law.

5. Cancellations and Rescheduling

We understand that schedules change. We ask that you notify us at least 2 hours in advance if you need to cancel or reschedule your backflow test. Failure to provide adequate notice may result in a late cancellation fee.

6. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal actions or proceedings arising out of these terms shall be filed in the appropriate court operating within Florida.

7. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Any updates will be posted directly to this page with an updated "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of those modifications.
